    FREQUENTLY ASKED QUESTIONS

Will it be necessary for UK nationals to obtain a residence permit? What steps will be required to obtain a residence permit?

Bitish nationals present in France before 31 December 2020 will have to apply for the new title provided for in the withdrawal agreement. They will be able to apply for it before the end of July 2021, according to modalities that will be specified later.

British nationals arriving in France after 1 January 2021 will have to apply for a common law title.

What are the official criteria for British nationals already residing in France who would like to apply for a residence permit?

The criteria will be the same as those currently prevailing for the recognition of a right of residence for a European Union national. UK nationals will have to demonstrate that they fall into one of the following situations:

1- Either they are in employment (or have been in employment and are registered as a jobseeker); or

2- Have sufficient resources for oneself and one’s family, as well as health insurance.

3- Either follow studies or professional training and have health insurance

4- Either be a family member of a British or European Union national settled in France before 1 January 2021 and having a right of residence there (spouse, child, ascendant, partner, cohabitant or family member taken in charge or forming part of the household of a British or European Union national).

Will residence permits obtained before March 2019 still be valid after the March deadline?

Credentials marked “European Union citizen” obtained before the date of withdrawal of the United Kingdom from the European Union (possession of which is not compulsory) will continue to be valid until 31 December 2020. However, after this period, they will have to be replaced by the new title provided for in the Agreement. Applications for the title may be submitted in accordance with a timetable to be specified at a later date and in any event at least until July 2021.

Will the residence permits issued in France allow mobility within the other countries of the European Union?

Residence permits issued in France will allow, in addition to settling in France, movement in the other States belonging to the Schengen area for periods not exceeding three months.

Will British citizens have to obtain a work permit in order to continue their professional activity in France?

British nationals who started their professional activity in France before 31 December 2020 will not need a work permit. Only those who settled in France on or after 1 January 2021 will be required to apply for a work permit.

What are the criteria for issuing residence permits for self-employed persons?

UK nationals who were self-employed before 31 December 2020 will be required to provide evidence by any means of the regular, effective and sustainable pursuit of their activity.
